Important Information on Waste Disposal

The local authorities in Kirklees and Calderdale charge business to dispose of any waste at their refuse sites.

This means that anybody who takes scrap or waste from your home, as part of a job that they do for you, will have to pay to dispose of it legally.

Unless you have proof that you have passed this waste on to a registered carrier of waste, then you, the homeowner, are still responsible for the items.

Unfortunately not all waste taken away is disposed of responsibly, and rather than pay to legally tip items, some contractors simply 'fly tip' the waste, or try to take commercial waste to the recycle centre and pass it off as their own.

From the 21st November 2005, the Waste (Household Waste) Duty of Care (England & Wales) Regulations 2005 require householders to take reasonable measures to ensure that household waste produced on their property is passed on to an authorised person (a registered waste carrier would be such a person) or to a person for authorised transport purposes.

The Environmental Protection Act 1990 makes provision for fines of up to £5000 in a Magistrates' Court and unlimited fines in a Crown Court to be imposed on offenders.

Always ask to see the contractor's Certificate of Registration, make a note of the contractor's Environment Agency Registration Number and always ask for a waste transfer document.

Without the correct documentation you could be held responsible for the waste long after it has left your property.
